November 17, 2011 Statement from Sublette County and Prosecuting Attorney Neal R. Stelting: "W.S. 18-3-501 governs the authority and procedure to increase or decrease the number of offices on the Board of County Commissioners. The statute clearly gives the citizens the power to determine the number of commissioners that hold office on the Board. There is no direct prohibition against a petition and proposition to revert back to 3 commissioners prior to actually filling the two vacant offices that were created by the last special election. Each citizen’s right to vote to determine their representation in government is an inherent right guaranteed by the Wyoming Constitution. It is not the role of county government to deny or limit the citizens’ right to vote, unless there is a direct prohibition or limitation enacted by the State legislature. In this case, there is no such prohibition or limitation."
