State outlines special election rules

Secretary of State Max Maxfield issued a media release explaining the process for the conduct of a special election.
"We have been receiving a number of phone calls asking about the process of a special election. These questions have been precipitated by the closeness of the election in House District 22."
State statutes, especially W.S. 22-16-122, address when and how a special election is to be conducted.
Basically, a special election is held if a material error is made in the conduct of the election; and if the error involves a number of votes which could affect the outcome of the election. In the case of a legislative race, election results are submitted to the Secretary of State’s Office by the county canvassing boards of the counties represented by the legislative district. That information is presented to the State Canvassing Board.
This year, the Board is required to meet on November 12, 2008. The State Canvassing Board will determine if any special election is warranted. If warranted, the special election will be held on November 25, 2008.
"Only the State Canvassing Board can determine the need for a special election for a legislative seat. Therefore, no further results or determinations can be released from my office prior to the State Canvassing Board meeting. That Board meets on November 12th at 10:00 a.m. in the State Capitol Building," Maxfield said.
